خلیفہ کے خلاف فیصلہ
عتبی کہتے ہیں کہ میں اموی خلیفہ ہشام بن عبد الملک (105تا125ھ) کے قاضی کے پاس بیٹھا ہوا تھا۔ اتنے میں قاضی کی عدالت میں دو آدمی حاضر ہوئے ۔ ایک ابراہیم بن محمد بن طلحہ اور دوسرا خلیفہ ہشام کا در باری سپاہی۔ دونوں عدالت میں پہنچ کر قاضی صاحب کے سامنے بیٹھ گئے۔
درباری سپاہی گویا ہوا: قاضی صاحب! امیر المومنین اور ابراہیم کے درمیان ایک تنازع ہے۔ امیر المومنین نے مجھے اپنی جانب سے نیابت کے لیے بھیجا ہے۔
قاضی: تمھاری نیابت پردو گواہ مطلوب ہیں۔
درباری سپاہی: کیا آپ سمجھتے ہیں کہ میں امیر المومنین کی طرف سے کچھ جھوٹ بولوں گا، حالانکہ میرے اور ان کے درمیان کوئی دور کا فاصلہ نہیں ہے، میں ان کا قریبی سپاہی ہوں۔
قاضی: بغیر شہادت کے نہ تمھارے حق میں مقدمہ ثابت ہوسکتا ہے اور نہ تمھارے خلاف۔
قاضی کا دوٹوک کلام سن کر درباری سپاہی عدالت سے نکل کر خلیفہ کی خدمت میں پہنچا اور اسے پوری داستان کہہ سنائی ۔ خلیفہ سنتے ہی اٹھ کھڑا ہوا اور تھوڑی ہی دیر بعد وہ عدالت کے باہر موجود تھا۔ عدالت کا دروازہ کھلتے ہی در پاری سپاہی آگے بڑھا اور گویا ہوا: قاضی صاحب! یہ دیکھیں امیر المومنین حاضر ہو گئے۔
خلیفہ ہشام کو دیکھتے ہی قاضی صاحب استقبال کے لیے اٹھ کھڑے ہوئے مگر خلیفہ نے انھیں بیٹھنے کا حکم دیا۔ پھر قاضی نے ایک مصلی بچھایا اس پر خلیفہ اور اس کا مقابل ابراہیم بن محمد ایک ساتھ بیٹھ گئے۔
عتبی بیان کرتے ہیں کہ ہم حاضرین اس قضیے سے متعلق ان کے درمیان ہونے والی گفتگو صاف صاف نہیں سن رہے تھے، البتہ کچھ باتیں ہمیں سمجھ میں آرہی تھیں ۔ دونوں مدعیوں نے اپنے اپنے دلائل بیان کیے۔ قاضی نے دونوں کی مفصل گفتگو سننے کے بعد خلیفہ ہشام کے خلاف فیصلہ دیا۔ ابراہیم بن محمد نے اپنے حق میں فیصلہ سن کر خلیفہ کی شان میں چند گستاخی آمیز کلمات کہہ دیے، مزید یہ بھی کہا:
“تمام تعریف اللہ ہی کے لیے ہے جس نے لوگوں کے رو برو آپ کا ظلم ظاہر کردیا!”
یہ سن کر خلیفہ طیش میں آ گیا اور کہنے لگا:
“جی چاہتا ہے کہ تیری گردن پر ایسی ضرب لگاؤں جس سے تیری ہڈی سے تیرا گوشت الگ ہو جائے ۔”
ابراہیم بن محمد نے کہا: اللہ کی قسم! اگر آپ نے ایسا کیا تو ایک عمر دراز اورحق قرابت رکھنے والے کے ساتھ یہ غیر مناسب سلوک ہوگا۔
خلیفہ ہشام نے کہا: ابراہیم !اس قضیے کو صیغہ راز ہی میں رہنے دو –”
ابراہیم نے جواب دیا:
“اگر میں نے اس مقدمہ کو صیغہ راز میں رکھا تو اللہ تعالی میرے اس گناہ کوقیامت کے دن پوشیدہ نہ رکھے” (یعنی میں ضرور لوگوں کو بتاؤں گا۔)
خلیفہ کہنے لگا: میں اس مقدمے کو چھپانے کے لیے تمھیں ایک لاکھ درہم عنایت کروں گا۔
جب خلیفہ کی وفات ہو گئی تو ابراہیم بن محمد کی زبان سے لوگ یہ کلمات سنا کرتے تھے
“چنانچہ میں نے خلیفہ کی حیات میں اس مقدمے کو اس کی عطا کردہ قیمت کے عوض چھپائے رکھا اور جب اس کی وفات ہوئی تو اس کی خوبی کے اظہار کے لیے اس راز کو فاش کر دیا ۔“
